1. Acceptance of Terms

By accessing or using Grandus (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Grandus is a health monitoring application that collects and analyzes biometric data from your Fitbit device, including heart rate and skin temperature measurements. The Service provides consumer health insights, trend analysis, and personalized reports.

3. Fitbit Integration

3.1 Authorization

To use our Service, you must authorize us to access specific data from your Fitbit account. By granting this authorization, you permit us to collect:

  • Heart rate data

  • Skin temperature data

  • Other data necessary for the Service to function

3.2 Fitbit Terms

Your use of Fitbit devices and services is also governed by Fitbit's Terms of Service. You are responsible for complying with Fitbit's terms.

3.3 Revocation

You may revoke our access to your Fitbit data at any time by disconnecting your account in the app settings or through your Fitbit account settings. Revoking access will terminate your use of the Service.

4. User Accounts

4.1 Account Creation

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

4.3 Eligibility

You must be at least 18 years old to use the Service. If you are between 13 and 18, you must have parental consent.

We do not guarantee that the Service will be available at all times or error-free. We are not liable for any downtime or service interruptions.

11. Termination

11.1 By You

You may terminate your account at any time by emailing aks@guardanthealth.com.

11.2 By Us

We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason, with or without notice.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will meet your requirements

  • The Service will be uninterrupted, timely, or error-free

  • The results obtained from the Service will be accurate or reliable

  • Any errors in the Service will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR COMPANY NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service

  • Any unauthorized access to or use of your data

  • Any interruption or cessation of the Service

  • Any bugs, viruses, or other harmful code

  • Any errors or omissions in any content

  • Any health outcomes or decisions based on the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Grandus, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in San Francisco.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Grandus regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

16.5 Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email. Your continued use of the Service after changes constitutes acceptance.
